TERMS: Sealed bids must be submitted to the offices of Joe R. Pyle Complete Auction & Realty, LLC located at 5546 Benedum Drive Shinnston, WV by 4:00PM Eastern on Thursday, June 4, 2020. Opening of bids will be held at the Pyle facility with no less than three agents present. A fully executed bid package along with certified funds representing 10% of the high bid will be required to be submitted with bid. Any bid received without the 10% down payment will be disqualified. The sale of HIG shall be “as is, where is” with no warranties, express or implied, provided by the WVDOT, the WVPPA, the State of West Virginia, or Joe R. Pyle Complete Auction & Realty, LLC. No financing contingencies will be entered into the contract. Any required inspections must be completed prior to bidding. Closing within 30 days from written notification of high bid with property conveyed by special warranty deed. Should successful high bidder fail to close on the property, the 10% down payment will be forfeited as liquidated damages.
Property to be used exclusively for operation of a “Qualifying Facility” defined in the Donation Deed from Norfolk Southern Rail Corporation, a Virginia Corporation and Virginia Holdings Corporation, a Virginia Corporation. Further, purchaser must comply with use restrictions and covenants set forth in the Donation Deed, dated November 15, 2011. Said Deed is recorded in Deed Book 680 at Page 63 in the Wayne County Clerk’s Office, Wayne, WV.
